The Case in Chief phase of a criminal trial is where the “Prosecution” establishes the “Burden of Proof” by presenting its evidence. The rebuttal phase of the trial is where the “Defense” seeks to contradict the evidence presented.
Key to the successful prosecution of criminal cases is the proper articulation of the evidence that establishes the “Burden of Proof” in a court of law. As is most often the case, this responsibility rest upon the shoulders of professional law enforcement officers. Moreover, the “Defense”, in its efforts to rebut the evidence, will focus on that same articulation to discredit the officer and thus derail the Prosecution’s case.
